LISHKARA – TERMS & CONDITIONS

Last updated: 16 September 2026

These Terms and Conditions apply to the website lishkara.co.uk and to products and services supplied by Lishkara, including restaurant dining, table reservations, takeaway and collection orders, delivery orders where applicable, private hire, group bookings, catering, tiffin services, bulk food and sweet orders, celebrations, corporate events and other services offered by us.

Please read these Terms before placing an order, making a reservation or confirming a booking.

1. About Lishkara

Lishkara is a trading name of:

TERA PUNJAB LTD
Company number: 16893564
Registered office: Delta 606, Welton Road, Swindon, SN5 7XF

Trading address:
Lishkara
32 Havelock Street
Swindon
SN1 1SD

Telephone: 01793 550351
Email: info@lishkara.co.uk
Website: lishkara.co.uk

References in these Terms to “Lishkara”, “we”, “us” or “our” mean TERA PUNJAB LTD trading as Lishkara.

References to “customer”, “you” or “your” mean the person placing an order, making a booking or entering into an agreement with us.

2. Acceptance of these Terms

By placing an order with us, making a confirmed reservation, paying a deposit, accepting a quotation or otherwise purchasing a service from Lishkara, you agree to the Terms applicable to that transaction.

A specific written quotation, booking confirmation or agreed event package may contain additional terms. Where a specific written agreement conflicts with these general Terms, the specific written agreement will normally take priority for that booking.

Nothing in these Terms affects your statutory rights as a consumer.

3. Enquiries are not confirmed bookings

Submitting an enquiry through our website, email, telephone, social media or enquiry form does not by itself create a confirmed booking or contract.

This is particularly important for:

Private Hire; Catering; Bulk Orders; Bhaji Boxes; Tiffin Services; Corporate Events; Large Group Bookings; and special or bespoke orders.

A booking becomes confirmed when we confirm it to you and, where required, the requested deposit or payment has been received.

Availability shown or discussed before confirmation is not guaranteed.

4. Menus, prices and availability

Menus, photographs, descriptions and prices on our website are provided to help customers make their selection.

Food is prepared by hand, so appearance, colour, presentation and portion shape may vary reasonably from photographs.

Ingredients, dishes and availability can change because of seasonality, supplier availability or other operational reasons.

We may withdraw an item before an order is accepted if it is unavailable.

We will not knowingly substitute an item where doing so could affect an allergen or dietary requirement without appropriate consideration and, where necessary, agreement from the customer.

The price applicable to an accepted order or booking will be the price shown or agreed when the contract is confirmed, subject to any changes subsequently requested and agreed by the customer.

We reserve the right to change prices and menus for future orders and bookings.

If an obvious pricing, typographical or technical error occurs, we may correct it before accepting the order. If payment has already been taken for an order we cannot accept because of such an error, the relevant payment will be refunded.

5. Allergies, intolerances and dietary requirements

Lishkara takes food allergies and intolerances seriously.

Customers with an allergy or intolerance must tell us before ordering and should reconfirm the requirement with a member of staff when dining with us or collecting an order.

Our kitchen handles a range of allergens and ingredients. Although we take reasonable precautions and follow our food safety procedures, food is prepared in a working restaurant kitchen and accidental cross-contact can occur.

Our allergen information should therefore be consulted together with a discussion with our staff where you have an allergy or intolerance.

Recipes, ingredients and suppliers can change. Customers with allergies should check allergen information each time they order, even if they have eaten the dish previously.

Vegetarian, vegan or other dietary descriptions refer to the intended ingredients of the dish. Unless expressly confirmed otherwise, they should not be interpreted as a guarantee that the food was prepared in an entirely separate kitchen or environment.

Nothing in this section limits our obligations under applicable food safety or allergen legislation.

Our current detailed allergen information is available separately on our Legal/Allergen page. Your existing Lishkara allergen matrix covers the regulated allergen categories and was reviewed on 15 September 2026.

6. Table reservations

Table reservations are subject to availability.

We will make reasonable efforts to provide the requested table and time, but a reservation does not guarantee a particular table, position or seating arrangement unless this has specifically been agreed.

Standard downstairs table bookings are intended for groups of up to the number shown on our booking system. Larger groups may be asked to use our Private Lounge or make a separate group arrangement.

Where a reservation is made for a specified time slot, customers should arrive promptly.

Our standard dining reservation may be allocated approximately two hours. Customers are welcome to remain longer where the table is not required for another booking, but we may reasonably ask for the table back at the end of the booked period where another reservation follows.

If you expect to be late, please contact us. A significantly delayed arrival may reduce the time available for the booking or, where we cannot reasonably continue holding the table, result in the reservation being released.

7. Table reservation deposits, cancellations and no-shows

Where our booking system requires a deposit, the amount displayed when the reservation is made applies.

The deposit will normally be deducted from the customer's final restaurant bill.

For standard table reservations:

Cancellation at least 24 hours before the booking: the reservation deposit will normally be refunded in full.

Cancellation less than 24 hours before the booking or a no-show: we may retain some or all of the deposit to the extent reasonably reflecting the loss caused to Lishkara by the late cancellation or no-show.

If Lishkara cancels your reservation and cannot offer an acceptable alternative, any reservation deposit paid to us will be refunded.

Deposits and cancellation charges will always remain subject to applicable consumer law.

8. Restaurant service and waiting times

Our food is prepared fresh and cooking times vary between dishes.

Any preparation or service time given by our staff, website or ordering system is an estimate rather than a guarantee unless we have expressly agreed otherwise.

During busy periods, large bookings or unexpected circumstances, orders may take longer.

We will make reasonable efforts to inform customers about significant delays.

9. Takeaway and Order & Collect

Collection orders are prepared for the collection time requested or confirmed.

Customers are responsible for providing correct contact details and checking their order confirmation.

Please collect food promptly. Food quality naturally changes as hot food cools, and we cannot be responsible for deterioration caused solely by an unreasonable delay by the customer after the food has been prepared or collected.

For food-safety reasons, we cannot hold prepared food indefinitely.

If a customer fails to collect a made-to-order meal, a refund may not be available to the extent that the food has already been prepared and Lishkara has incurred an unavoidable loss.

This does not affect your rights where food is faulty, unsafe, materially different from what was ordered or otherwise fails to meet applicable legal requirements.

10. Cancellation of prepared and perishable food

Many products sold by Lishkara are fresh, perishable and/or prepared specifically for the customer's order.

Once preparation has begun, cancellation or amendment may therefore not always be possible.

Statutory change-of-mind cancellation rights applicable to some online purchases may not apply to food that deteriorates or expires rapidly or to certain genuinely personalised products.

Nothing in these Terms removes your rights where goods are faulty, unsafe or not as described.

11. Delivery and third-party ordering platforms

Lishkara may be available through third-party ordering or delivery services.

Orders placed through a third-party platform may also be governed by that platform's terms, payment procedures, cancellation rules and delivery arrangements.

Where an independent delivery platform contracts with the customer to provide delivery, issues relating specifically to its courier service may need to be raised with that platform.

Lishkara remains responsible for obligations that the law places on Lishkara, including applicable responsibilities concerning the food we prepare.

Third-party estimated delivery times are estimates.

Where a delivery fails or is delayed because a customer supplied an incorrect address, incorrect contact details, failed to answer or failed to provide reasonable access, additional costs or loss associated with the failed delivery may be borne by the customer where permitted by law.

Nothing in this section removes any statutory rights against either Lishkara or a relevant third-party service provider.

12. Tiffin Service

Registration for the Lishkara Tiffin Service is an expression of interest until we confirm the customer's arrangement.

Tiffin menus may rotate and ingredients may change.

Collection days, times, quantities, meal type, price and payment arrangements will be those confirmed with the customer.

Where a customer prepays for a period, a later general price increase will not retrospectively alter the price of meals already paid for.

Prices for future periods may be changed by giving customers reasonable notice before they commit to the new period.

Customers wishing to change or cancel a scheduled tiffin should do so by any cut-off time communicated with their plan.

Where a customer cancels after food has already been prepared, or fails to collect an agreed tiffin, we may charge for the meal to the extent that we have incurred a reasonable unavoidable loss.

All allergen provisions in these Terms also apply to the Tiffin Service.

13. Private Lounge and private events

Our private event area is located on the first floor of Lishkara.

It is accessible by stairs only and there is currently no lift.

The maximum seated capacity advertised by Lishkara is up to 30 people, although the practical capacity may be lower depending on table arrangement, decorations, equipment and the nature of the event.

Customers must disclose the expected number of guests accurately.

We may refuse admission to additional guests where admitting them would exceed a safe or agreed capacity.

A Private Lounge enquiry is not a confirmed booking until confirmed by Lishkara and any requested deposit has been received.

The booking confirmation may specify:

the date and times; agreed guest numbers; menu; drinks; price per person; minimum spend; deposit; room arrangements; and any special requirements.

Those details form part of the contract.

14. Final guest numbers for private events

For events involving pre-ordered food or set menus, we may ask for a final guaranteed number of guests by a specified deadline.

Once that number has been confirmed and food, ingredients or staffing have been committed, charges may be based on the final confirmed number even if fewer guests ultimately attend.

Additional guests are subject to capacity and food availability and may incur additional charges.

Changes requested after the agreed cut-off are subject to our ability to accommodate them.

15. Private hire deposits and cancellations

The applicable deposit and cancellation arrangements will be shown in your quotation or booking confirmation.

If a customer cancels a private event, Lishkara may retain or charge an amount reasonably necessary to cover losses directly resulting from the cancellation, including commitments already made for food, ingredients, staffing or other booking-specific costs that we cannot reasonably avoid.

We will take reasonable steps to reduce avoidable losses where appropriate.

We will not impose cancellation charges that exceed what is permitted by law.

If Lishkara has to cancel an event and cannot provide an acceptable alternative, monies paid for services we are unable to provide will be refunded as required by law.

16. Decorations and use of the Private Lounge

Customers may bring agreed decorations such as balloons, flowers, banners, table decorations, cakes, photo backdrops and welcome signs.

Large decorations, electrical equipment, entertainment equipment or unusual installations require prior approval.

Nothing may be fixed to walls, ceilings, furniture or equipment in a way likely to cause damage.

Open flames, pyrotechnics, smoke or haze equipment, dangerous items or anything that could interfere with fire-detection or safety systems must not be used without our express permission and any legally required approval.

Customers must remove decorations and personal items within the agreed timeframe unless we agree otherwise.

Reasonable additional cleaning, repair or replacement costs may be charged where damage or excessive mess is caused by the customer, their guests or contractors, provided the amount reflects the reasonable loss incurred.

17. Cakes and food supplied by customers

Celebration cakes or other external food may only be brought onto the premises where permitted by Lishkara.

Food that Lishkara has not prepared is outside our control.

Customers bringing food onto the premises are responsible for obtaining appropriate ingredient and allergen information for that food and for informing their own guests as appropriate.

Lishkara remains responsible for food prepared and supplied by Lishkara in accordance with applicable law.

18. TV, music and customer-provided media

Our Private Lounge includes a large television and facilities that may be used for presentations, photographs, videos, entertainment or other agreed purposes.

Compatibility with every phone, laptop, file format, casting technology or third-party streaming service cannot be guaranteed.

Customers using the TV for an important presentation or video are encouraged to test their equipment before their event.

Unless expressly agreed in writing as an essential element of a booking, TV, casting, internet and similar facilities are ancillary facilities.

Customers are responsible for ensuring that any photographs, video, music, presentation or other material they provide or display does not unlawfully infringe copyright, privacy or other third-party rights.

19. Cricket Lounge and sporting broadcasts

Match schedules, start times and broadcast arrangements can change.

Fixtures, live scores or other sporting information displayed through third-party feeds or widgets are provided for general information and may contain delays or inaccuracies.

Availability of a particular television broadcast may depend on broadcasting rights, subscriptions, technical availability and circumstances outside Lishkara's reasonable control.

Customers should contact us if viewing a specific match is essential to their booking.

We will not intentionally advertise a confirmed broadcast that we know is unavailable.

20. Catering

A catering enquiry is not confirmed until Lishkara has provided confirmation and any required deposit has been received.

The customer's catering confirmation or quotation will determine the agreed menu, guest numbers, quantities, venue, service type, timings, staffing, equipment, delivery/collection arrangements and price.

Customers are responsible for supplying accurate information about the event and venue.

For catering at external premises, the customer or venue must provide any facilities agreed as necessary, which may include suitable access, parking, electricity, water, preparation areas, service space and tables.

Additional cost caused by a material change to the venue, access, timing, guest numbers or requirements may be charged where agreed or otherwise permitted by law.

21. Catering guest numbers and menu changes

We may require final menu choices and guaranteed guest numbers before the event.

Once final numbers have been confirmed and ingredients or staffing have been committed, charges may be based on those confirmed numbers even if fewer guests attend.

Late increases in guest numbers are subject to availability.

We cannot guarantee that significant last-minute menu changes can be accommodated.

Allergen and dietary information should be provided as early as possible and reconfirmed before service.

22. Catering at external venues

The person making the booking is responsible for ensuring that Lishkara is permitted to operate at the chosen venue and that the venue is suitable for the service requested.

Where alcohol, entertainment or another licensable activity is requested, it will only be provided where legally permitted and where any necessary permissions or licences are in place.

We may refuse to provide any service that we reasonably believe would breach licensing, food-safety or other legal requirements.

23. Food after catering handover

Where food is collected by the customer or formally handed over for the customer or venue to store and serve, customers should follow any storage, temperature and consumption instructions supplied by Lishkara.

We are not responsible for deterioration caused after handover by improper storage, excessive delay, reheating or handling outside our control.

This does not exclude liability for a defect or food-safety problem that existed when the food was supplied by us.

24. Bulk Orders, Bhaji Boxes, sweets and savouries

Bulk-order forms on our website are normally enquiry forms, not automatic purchase contracts.

The minimum quantities displayed on the relevant page apply unless we agree otherwise.

Lishkara will confirm availability, quantity, final price, collection arrangements and any deposit before the order becomes confirmed.

Traditional sweets, savouries and Bhaji products are handmade. Individual pieces may therefore reasonably vary in appearance, shape and size.

Where goods are sold by weight or specified quantity, the agreed quantity will be supplied in accordance with applicable legal requirements.

Photographs are illustrative and natural variations in handmade products are not by themselves defects.

25. Personalised and special bulk orders

Where a bulk order includes personalised labels, packaging, invitations, names, wording, colours or other custom requirements, customers are responsible for providing accurate information.

If we supply a proof for approval, customers should check names, dates, spelling, quantities and design details carefully.

Where Lishkara has reproduced an approved customer proof correctly, we are not responsible for an error that was already present in that approved proof.

Once bespoke preparation or production has started, changes or cancellations may not be possible without costs being incurred.

26. Alcohol

Alcohol will only be sold or supplied in accordance with our premises licence and applicable law.

You must be 18 or over to purchase alcohol.

Lishkara operates an age-verification policy and may operate Challenge 25. Customers who appear under 25 may be asked for acceptable photographic proof of age.

We may refuse the sale or supply of alcohol if suitable identification is not provided or where the sale would otherwise be unlawful.

We may also refuse alcohol service to an intoxicated person or where our staff reasonably believe supplying alcohol would be unsafe or unlawful.

Where alcohol is ordered for takeaway or delivery, additional licence conditions, packaging, ordering and age-verification requirements may apply.

Customers must not bring their own alcohol onto the premises unless Lishkara has expressly agreed.

27. Promotions, discounts and promotional codes

Promotions are subject to the conditions stated with the individual offer.

Unless an offer specifically states otherwise:

discounts cannot be exchanged for cash; promotional codes may have an expiry date; eligibility-based discounts may require appropriate evidence; one offer may not necessarily be combined with another offer; and an offer applying to restaurant or direct collection orders does not automatically apply to third-party delivery platforms, catering, private hire, bulk orders or tiffin services.

We may change or withdraw a promotion for future transactions.

A change will not retrospectively remove a discount already validly applied to an accepted order.

28. Customer behaviour

Customers and guests are expected to behave reasonably toward our staff, other customers and property.

We may refuse service or require a person to leave where they are threatening, abusive, violent, discriminatory, seriously disruptive, unlawfully intoxicated, using illegal drugs or otherwise creating a safety risk.

Where a booking has to be ended because of serious misconduct by the customer or their guests, any refund will depend on the services already provided, costs incurred and applicable law.

Illegal behaviour may be reported to the police or relevant authorities.

29. Children

Children remain the responsibility of the parent, guardian or responsible adult accompanying them.

Particular care should be taken around stairs, hot food, hot plates, glassware and restaurant equipment.

The first-floor Private Lounge is accessed by stairs.

30. Customer property

Customers are responsible for keeping personal belongings safe.

We are not responsible for loss, theft or damage to personal property unless it results from our negligence or another circumstance in which liability cannot lawfully be excluded.

Any property left behind should be reported to us promptly.

31. Damage caused by customers or guests

The person making a private hire, catering or group booking is responsible for taking reasonable steps to ensure that their guests and any contractors they introduce respect our premises and equipment.

Where a customer, guest or contractor negligently or deliberately damages Lishkara property, we may seek reasonable repair, replacement or additional cleaning costs from the responsible person and/or, where legally appropriate, the booking customer.

We may provide evidence of the loss where reasonably requested.

32. Payments

Payments may be processed by Lishkara or by third-party payment providers.

Customers must use a payment method they are authorised to use.

Where a payment is declined, reversed or cancelled, a booking may remain unconfirmed until payment is successfully received.

If a payment is reversed after goods or services have legitimately been supplied and the amount remains lawfully payable, Lishkara reserves the right to recover the outstanding amount and any reasonable recovery costs permitted by law.

Nothing in these Terms removes a customer's legitimate rights through their card issuer, bank or payment provider.

33. Refunds and complaints about orders

If there is a problem with your food or order, please tell us as soon as reasonably possible so that we have an opportunity to investigate and, where appropriate, resolve the issue.

For takeaway or delivery complaints it is helpful to retain the food, packaging, receipt/order number and photographs where appropriate.

Reporting an issue promptly helps us investigate it but does not remove any statutory rights you may have.

Appropriate remedies may include replacement, correction, partial refund or refund depending on the circumstances and applicable law.

34. Events outside our reasonable control

Occasionally circumstances outside our reasonable control may prevent or materially affect a service.

Examples can include serious utility failures, fire, flood, severe weather, road closure, government restrictions, major supplier disruption, widespread technology failure or other exceptional events that could not reasonably have been avoided.

Where this occurs, we will take reasonable steps to minimise the effect and contact affected customers where practicable.

Depending upon the circumstances we may offer an alternative date, substitute arrangement or refund as required by applicable law.

This clause does not allow Lishkara to retain customer money where doing so would be unlawful.

35. Third-party websites and services

Our website may contain links or integrations relating to payment providers, ordering services, delivery companies, maps, social networks, sports information or other third-party services.

Those services are operated independently and may have their own terms, privacy policies and availability.

A link from the Lishkara website does not mean we control all content or services supplied by that third party.

We are not responsible for independent third-party content or systems outside our reasonable control, except to the extent that the law makes Lishkara responsible.

36. Website availability and information

We make reasonable efforts to keep lishkara.co.uk accurate and available.

However, temporary technical problems, maintenance or third-party outages may occur.

We do not guarantee that every part of the website will be continuously available or error-free.

If website information conflicts with a specific written booking confirmation, the confirmed agreement will normally take priority.

37. Intellectual property

Unless otherwise stated, the content of the Lishkara website, including the Lishkara name and branding, website text, menus, graphics, photographs created or commissioned by us and other original material, belongs to Lishkara or is used under licence.

Customers may view and use website material for ordinary personal purposes.

Material must not be commercially reproduced, sold, republished, substantially copied or used in a way that falsely suggests an association with or endorsement by Lishkara without permission, except where the law permits such use.

38. Privacy and personal information

Personal information supplied to Lishkara may be used to administer orders, bookings, enquiries, payments, customer service and the operation of our business.

Our use of personal data is governed by our separate Privacy Policy.

Acceptance of these Terms does not automatically constitute consent to receive marketing.

Where marketing consent is required, we will request it separately or otherwise send marketing only where permitted by law.

Customers may opt out of direct marketing as described in our Privacy Policy and relevant communications.

We do not sell customer personal information to third parties for their own independent marketing purposes.

39. Cookies

Our website may use essential cookies required for its operation and may use optional analytics, functionality or marketing technologies.

Details should be provided through our separate Cookie Policy and cookie-consent controls where required.

40. Our liability to consumers

Nothing in these Terms excludes or restricts liability where it would be unlawful to do so.

In particular, nothing seeks to exclude liability for:

death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or statutory consumer rights that cannot legally be excluded.

If we fail to comply with these Terms, we are responsible for loss or damage that is a reasonably foreseeable consequence of our breach or failure to exercise reasonable care and skill.

We are not responsible for loss that was not reasonably foreseeable or that results solely from circumstances outside our reasonable control, subject always to applicable law.

Where you are a consumer, our products and services are supplied for private use. We are not responsible for commercial losses such as loss of profit, revenue or business opportunity arising from consumer use, except where the law provides otherwise.

41. Business and corporate customers

This section applies where the person contracting with Lishkara is acting wholly or mainly for purposes relating to their trade, business, craft or profession rather than as a consumer.

To the fullest extent permitted by law, Lishkara will not be liable to a business customer for indirect or consequential losses or for loss of profit, revenue, business, anticipated savings or goodwill.

Subject to liabilities that cannot lawfully be limited, Lishkara's aggregate contractual liability to a business customer arising from a particular booking or order shall not exceed the amount paid or payable to Lishkara for that booking or order.

Nothing in this section excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability which cannot lawfully be excluded or restricted.

A business customer is responsible for claims or losses reasonably resulting from its own breach of these Terms, negligence, unlawful instructions, unauthorised use of third-party material or the acts of contractors engaged directly by that customer.

42. Cancellation by Lishkara

We may cancel or refuse a booking where there is a genuine operational, legal or safety reason, including circumstances where:

payment has not been made as agreed; information supplied for the booking is materially incorrect; the requested activity would be unlawful; safe capacity would be exceeded; customers or guests create a serious safety risk; or circumstances outside our reasonable control mean we cannot provide the service.

Where the customer is not responsible for the cancellation, refunds will be handled in accordance with applicable law and the circumstances of the booking.

43. Changes requested by customers

Any material change to a confirmed private event, catering service, bulk order or other bespoke booking must be agreed by Lishkara.

Changes in guest numbers, timings, menu, venue, quantities, staffing, equipment or service requirements may change the price.

We will tell you about an additional charge before committing to a material customer-requested change wherever reasonably practicable.

44. Complaints

We want customers to give us an opportunity to resolve concerns directly.

Complaints can be made using:

Email: info@lishkara.co.uk
Telephone: 01793 550351
Address: Lishkara, 32 Havelock Street, Swindon, SN1 1SD

Please provide your name, order or booking details, date of service and a description of the problem.

We will consider complaints reasonably and may request relevant evidence where necessary to investigate.

45. Changes to these Terms

We may update these Terms when our services, business practices or legal obligations change.

The Terms applicable to a transaction will normally be those in force when the relevant order or booking is accepted.

A later update will not retrospectively remove contractual rights already agreed with a customer unless the law requires a change or both parties agree.

46. Severability

If a court or competent authority determines that part of these Terms is unlawful or unenforceable, that part will be treated as removed or limited to the minimum extent necessary.

The remaining Terms will continue to apply.

47. No waiver

If Lishkara does not immediately enforce a right under these Terms, this does not normally mean that we have permanently waived that right.

48. Governing law and disputes

These Terms are governed by the laws of England and Wales.

If you are a consumer, nothing in this clause removes any mandatory legal right you may have regarding where proceedings can be brought.

For contracts between Lishkara and business customers, the courts of England and Wales will have exclusive jurisdiction unless otherwise agreed in writing.
